⚖️ Terms of Service — NoteAble AI

These Terms of Service (“Terms”) govern your use of NoteAble AI, operated by Matthew Giglio, based in Adelaide, South Australia.

1. Acceptance

By using NoteAble AI, you agree to these Terms.
If you do not agree, you must not access or use the service.

2. Description of Service

NoteAble AI provides AI-assisted note-taking tools for NDIS support workers to help with documentation and compliance.
This service is in beta and provided for testing and evaluation only.
It is not a registered NDIS software provider and does not replace human review or professional compliance processes.
We are not a registered NDIS provider.

3. Your Responsibilities

You agree to:

  • Keep your login details secure.
  • Ensure all data you enter is lawful and accurate.
  • Obtain participant consent where required by law or your organization.
  • Not upload harmful or unauthorised material.
  • Validate all AI outputs: You acknowledge that AI drafts may contain errors and you are solely responsible for reviewing and editing notes before submission.

4. AI-Generated Content

AI drafts are automatically generated based on your inputs.
They may contain errors, hallucinations, or inaccuracies.
You are responsible for reviewing and validating all AI-generated content before using it in any professional context. NoteAble AI is a drafting tool, not a clinical decision-making tool.

5. Data Ownership and Security

You retain ownership of all content you upload or create within the platform.
By using NoteAble AI, you grant permission for the service to store and process this data solely for functionality, compliance, and improvement purposes.
Data is stored and processed using third-party cloud service providers.

6. Payments and "Founding Member" Offer

If you upgrade to a paid plan:

  • Fees are charged in AUD.
  • Payments are processed via secure third-party gateways (Stripe).
  • Founding Member Offer: Users who subscribe under the "Founding 100" offer are entitled to a locked rate of $19/month for the lifetime of their continuous subscription. If the subscription is cancelled or lapses, this rate may be forfeited.
  • 30-day money-back guarantee: If you subscribe under the "Founding 100" offer, you may request a refund within 30 days of your first payment.
  • Fees are non-refundable except as required by Australian Consumer Law or where explicitly stated above.

7. Beta Disclaimer

NoteAble AI is an MVP (Minimum Viable Product) and experimental product.
It is provided “as is” without guarantees of uptime, accuracy, or performance.
Use is at your own discretion and risk during the testing phase. We may modify or discontinue features at any time.

8. Limitation of Liability

To the fullest extent permitted by law, NoteAble AI and Matthew Giglio are not liable for any indirect or consequential loss resulting from the use (or inability to use) the service, including but not limited to data loss, compliance breaches, or business interruption.
Total liability is limited to the amount you have paid (if any) in the 12 months before a claim.

9. Termination

You may close your account at any time.
We may suspend or terminate access if you breach these Terms or misuse the service.

10. Governing Law

These Terms are governed by the laws of South Australia, Australia.
